Clean Energy Act
On May 23, 2018, Governor Phil Murphy signed the Clean Energy Act into law as L. 2018, c. 17 (“Clean Energy Act of 2018” or “CEA”).1 The CEA mandates the following (“Benchmarking Requirement”): No later than five years after the date of enactment of P.L.2018, c.17 (C.48:3-87.8 et al.), the board shall require the owner or operator of each commercial building over 25,000 square feet in the State to benchmark energy and water use for the prior calendar year using the United States Environmental Protection Agency’s Portfolio Manager tool.
What is Commercial Energy Benchmarking?
Benchmarking is a no-cost way to compare your facility's level of energy efficiency with that of similar facilities nationwide using a standard metric. Benchmarking can help you increase energy efficiency and reduce operating costs, which can help raise property values.

What is the goal of the Commercial Energy Benchmarking program?
There are several benefits to Commercial Energy Benchmarking including:
- Enable Commercial building owners to analyze their facilities’ energy and water use
- Ability to compare energy performance to similar buildings
- Assess improvement opportunities and ways to reduce energy use and costs
- Establish transparent benchmarks and energy labeling
What types of buildings are included in the Commercial Benchmarking program?
The BPU will send letters for any building classified as Class 4A and Class 4C by the Division of Taxation for tax assessments, including 15C municipal buildings. All other building owners that have not received a letter can also voluntarily participate in the program.
